This Privacy Policy (the "Policy") sets out the practices of LiveBarn Inc. and its affiliates with respect to the collection, use and disclosure of personal information and applies to the situations set out in Section 2 regarding the use of LiveBarn Analytics services. For ease of reference, we refer to ourselves as "LiveBarn" or simply "we".

For the purposes of this Policy, personal information is any information that allows a natural person to be identified, directly or indirectly.

By accepting our Policy or by providing us with personal information after having had the opportunity to consult it, you agree to your personal information being processed in accordance with our Policy.

2How do we use and disclose your personal information?

How we process your personal information will depend on your use of LiveBarn Analytics services. Below is a description of how LiveBarn Analytics collects, uses and discloses your personal information with the understanding that we may also process your personal information as required by applicable law or with your consent.

In the course of our activities relating to LiveBarn Analytics, we process personal information in the manner set out in sections 2.1 to 2.4:

2.1 To create and manage your user account/subscription as an administrator for a team

We collect personal information directly from you when you subscribe to use LiveBarn Analytics and create an administrator account on behalf of a team.

Note: If you provide us with personal information relating to a third party (such as a player and their parent/guardian), you must ensure that you have obtained the consent of that individual, or of their parent or legal guardian where applicable, before disclosing such information to us.

LiveBarn personnel who require access to perform their duties may access your personal information, in whole or in part, as necessary.

Sportlogiq, our service provider, may access your personal information and player information to identify players across games, track their performance, and provide player-related data.

We use service providers who provide software and maintenance services to host and process your personal information on our behalf.

Our online payment services are provided by a third-party service provider. We do not collect or store any payment details. All payment information is processed and stored by this third-party payment service provider.

2.2 To create a coach or parent profile to access player data

We collect personal information from coaches and parents/guardians to create a profile and access player data.

LiveBarn personnel who require access to perform their duties may access your personal information, in whole or in part, as necessary.

Players’ personal information may be accessed by the team coaches (max. 2). Individuals with a "Parent" account can only access their player data.

Sportlogiq, our service provider, may access your personal information and player information to identify players across games, track their performance, and provide player-related data.

We use service providers who provide software and maintenance services to host and process your personal information on our behalf.

2.3 To create analysis for players

How do we collect your personal information?

We use artificial intelligence ("AI") to produce player analysis derived from various data sources, including the personal information listed below.

The coach or team administrator matches the group of AI images of the presumptive player to the correct player profile.

2.4 When you communicate with our team by e-mail

In addition to the above description, LiveBarn Analytics will not disclose your personal information to any third parties without your consent, except as permitted by law or under the following limited circumstances:

  • Service providers and third-party partners for purposes such as accounting, legal, or tax preparation services; servicing accounts, conducting transactions, cloud storage services, system hosting services, surveys, market research, data analysis, reporting, marketing, and development of our products and services;
  • Regulatory, tax or other government authorities and agencies;
  • Our affiliates (i.e., companies related to us by common ownership or control) for purposes consistent with this Privacy Policy and various purposes permitted by law, including our affiliates’ advertising and marketing of their products and services to you;
  • Other individuals or entities, when we believe that disclosure is necessary to detect, prevent or report suspicious activities, prevent physical harm, financial loss or violations of our agreements and policies; and
  • For specific products or services, including third-party fintech apps and data aggregators, when you have given your consent.

3Minors under 14 years of age

If you are a minor under the age of 14 and are using LiveBarn Analytics, you may not provide us with any personal information without the express consent of a parent or guardian. If you are a parent or guardian and you are aware that your children have provided us with personal information without your consent, please contact us. If we discover that we have collected personal information from someone under the age of 14 without the consent of the parent or guardian, we will take steps to delete that information from our systems.

Coaches and account administrators must only share personal information regarding a minor under the age of 14 if they obtained explicit written consent from a parent or legal guardian. LiveBarn is not responsible for securing this consent.

4What cookies and similar technologies do we use?

We may use cookies and other similar technologies on our websites. A "cookie" is a unique numeric code that we transfer to your device so that we can keep track of your interests and/or preferences and recognize you as a return visitor to our websites. The use of cookies allows us to measure website activity and adapt the web application content and services to provide a better user experience. Cookies and other similar technologies may be used to tell us the time and length of your visit, the pages you look at on our websites, the website you visited just before coming to ours, and the name of your Internet service provider.

Most internet browsers accept cookies by default. You can block cookies by activating the setting on your browser that allows you to reject all or some cookies. The help and support area on your internet browser should have instructions on how to block or delete cookies. Some web browsers (including some mobile web browsers) provide settings that allow you to control or reject cookies or to alert you to when a cookie is placed on your computer, tablet or mobile device. Although you are not required to accept cookies, if you block or reject them, you may not have access to all of the features available through the services.

We may use third-party analytics such as Google Analytics or similar analytics services. For information on how Google processes and collects your information regarding Google Analytics and how you can opt-out, please see https://tools.google.com/dlpage/gaoptout.

We may use third-party advertisers to serve or track advertisements on or relating to the Services. These third parties may use cookies and other tracking and analytical technologies to, among other things, record which ads your browser has loaded and which pages you were viewing when ads were delivered or accessed. Information so collected is subject to the privacy policies of those third parties, which you should carefully review. We have limited or no control over third-party use of cookies.

5Where do we store personal information?

Your personal information is mainly held virtually on the servers of our service providers who are located in Canada and/or the United States.

Your personal information is disclosed outside of your province/state of residence only if we believe it is adequately protected. Disclosure will also be governed by an appropriate contractual agreement.

6Security measures and protection of your personal information

We deploy appropriate security measures to protect your personal information. In particular, we have put in place appropriate physical, technical and administrative safeguards to ensure the protection of your information.

In addition, we have implemented access control measures to limit access to your personal information to only those of our employees who require access in the course of their duties.

You also play an important role in protecting your privacy and the confidentiality of your personal information. For example, you should:

  • Create a strong and unique password for your user accounts
  • Never share your user accounts or password with anyone. We will never ask you for your password, including in any unsolicited communication such as letters, phone calls or email messages, so please contact us if you receive such a request.
  • Log out of your user account once you are finished using it, especially if you share your device with anyone else.
  • Have a strong and unique password on your device, too.
  • Never post information on our websites (such as on message boards and in chat rooms) that you are against or unwilling to be viewed or used by others.

If you have reason to believe that personal information has been compromised, please contact our Privacy Officer at the coordinates listed in section 1 of this Policy.

7What are your rights regarding your personal information?

By law, you have various rights with respect to your personal information. In particular, you have the following rights:

7.1 Access to your personal information

You may ask us whether we hold any personal information about you and, if so, you may request access to that personal information.

7.2 Rectification

You may ask us to rectify any incomplete or inaccurate personal information we hold about you.

7.3 Withdrawal of consent

In some cases, you may withdraw your consent to the disclosure or use of the personal information we hold about you. You understand, however, that in such a case, we will no longer be able to process your personal information in the ways set out in sections 2.1 to 2.4.

8.4 Portability

You may request that your personal information be disclosed to you or transferred to another organization in a structured, commonly used technological format.

9File a complaint about our handling of your personal information

LiveBarn takes complaints and comments about our handling of your personal information very seriously. We invite you to contact our Privacy Officer if you have any complaints or comments about our confidentiality practices.

Your complaint will be reviewed by the Privacy Officer, who will determine whether the processing of your personal information complies with our confidentiality program and any applicable laws.

You may also file a complaint with the Office of the Privacy Commissioner of Canada ("OPC") using the form available on the OPC’s website (if you are a U.S. or Canadian resident) or with the regulatory authority of your province of residence (if you are a Canadian resident). However, we invite you to first contact our Privacy Officer to give us a chance to address your concern.

This Policy does not apply to third-party websites, pages or applications that may be accessed through our website. If you follow such links, these third-party sites or services may have their own privacy policies that you should review before submitting your personal information.

11How do we update this Policy?

To ensure the clarity and transparency of our Privacy Policy, it may be amended from time to time. Changes will be posted on the LiveBarn Analytics website, along with the date of the last update. Changes will be effective as of the date of the last update.
